Carrick Group appeals Faulconbridge Crematorium Decision

Justice1The Blue Mountain Gazette reports that an appeal has been lodged against the NSW Land and Environment Court’s decision to refuse permission for a crematorium at Faulconbridge. The Carrick Group lodged the appeal on Monday, May 30 and it will come before a judge of the same court at a date yet to be announced.The appeal has been lodged following the decision handed down on May 2 by Commissioner Dixon and Assistant Commissioner Johnson that permission for a change of use for a funeral facility including a crematorium on land along the Great Western Highway be refused.

The court found the proposal by The Carrick Group did not satisfactorily address air quality issues or likely parking demand.

While the court found public sensitivity to the noise of the operating cremator was a “relevant concern”, it was “not determining of the appeal”.
