A heartless clause in the Cemeteries and Crematoria Act means ashes and plaques can be removed and disposed of after 25 years if a $430 fee has not been paid for perpetuity.

Springvale cemetery management has imposed an orange warning on the plaque of one Digger, R.T. Jeffery, of the 13 Light Horse Regiment, who died in 1957.

The warning states that "tenure on this memorial has expired", meaning, at some point in coming weeks, the veteran's ashes could be thrown out.

John Saddington, who is a member of the Southern Metropolitan Cemeteries Trust, said many families were unaware of the law.

He said the trust had decided that no ashes of veterans would be removed if the Office of Australian War Graves recognised them.
