What is the law applying to burial and burial sites
Primarily in NSW there is the
- Public Health Regulation (Disposal of Bodies) 2002 under the Public Health Act (NSW); and
- The By Law for Crown Land Reserves and Crown Lands (General Reserves). Amendment (Sustainable Burials). By-law 2011 under the. Crown Lands Act 1989
The Public Health Regulation is about the control of health and hygiene when dealing with the transport, preparation, burial and cremation of the deceased.
The By Law applies to the operation Crown Land Cemeteries in Cemeteries, although some local government authorities have acted to align their policies and management obligations with the By Law. The By Law deals with such matters as the allocation of cemetery land and the issuing and maintenance of burial licences.
Additionally privately operated cemeteries may operate under contractural arrangments.
